1. Acceptance of Terms

By downloading, installing, or using DivCal ("the App"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the App.

2. Description of Service

DivCal is a dividend tracking and portfolio management application for iOS. The App allows you to track dividend-paying stocks, view payment calendars, analyze portfolio income, and receive notifications about upcoming dividends.

3. Financial Disclaimer

The App is not a financial advisor. All information provided by the App, including dividend data, stock prices, safety scores, projections, and analytics, is for informational purposes only and should not be construed as financial advice, investment recommendations, or an endorsement of any security.

Dividend data is sourced from third-party providers and may be delayed, incomplete, or inaccurate.
Past dividend performance does not guarantee future payments.
Projections and calculations are estimates based on historical data and assumptions that may not reflect actual outcomes.
Always consult a qualified financial advisor before making investment decisions.

4. User Responsibilities

You are responsible for the accuracy of the portfolio data you enter into the App.
You are responsible for verifying any financial information before making investment decisions.
You must not use the App for any unlawful purpose.

5. In-App Purchases & Subscriptions

The App offers a free tier with basic features and a premium tier ("DivCal Pro") with additional features.
Subscriptions are billed through your Apple ID account via the App Store.
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
You can manage or cancel your subscription in your device's Settings → Apple ID → Subscriptions.
Free trial periods, if offered, automatically convert to paid subscriptions unless canceled before the trial ends.
Refunds are handled by Apple per their App Store refund policy.

6. Intellectual Property

The App, including its design, features, code, and content, is protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the App.

7. Data & Privacy

Your use of the App is also governed by our Privacy Policy. By using the App, you consent to the data practices described in the Privacy Policy.

8. Limitation of Liability

To the maximum extent permitted by law, the developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to financial losses based on information provided by the App.

The App is provided "as is" without warranties of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.

9. Data Accuracy

While we strive to provide accurate dividend and stock data, we do not guarantee the accuracy, completeness, or timeliness of any information displayed in the App. Data is sourced from third-party providers and may contain errors or delays.

10. Termination

We reserve the right to terminate or suspend access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or the App.

11. Changes to Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Continued use of the App after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the developer resides, without regard to conflict of law provisions.
